PLANNED RESIDENTIAL DEVELOPMENT,

SHORELINE SUBSTANTIAL DEVELOPMENT PERMIT,

SEPA APPEAL AND PUBLIC HEARING

NOTICE IS HEREBY GIVEN that on October 7, 2019, the City of Lynden received an application from Shane Bajema, Cedarbrook Partners, regarding the property described below:

LOT 1 OF THE VAN DYKEN SHORT PLAT, ACCORDING TO THE PLAT MAP THEREOF, RECORDED UNDER A.F. NO. 2000201901, RECORDS OF WHATCOM COUNTY WASHINGTON.  ALL SITUATE IN WHATCOM COUNTY WASHINGTON.

COMMONLY DESCRIBED AS: 131 E Cedar Drive, Lynden

for a Planned Residential Development and Shoreline Substantial Development Permit requesting to develop approximately 3.05 acres into 9 residential lots within the RS-100 zone and within the 200-foot shoreline jurisdiction of Fishtrap Creek. The application was determined to be complete on February 18, 2020, and the notice of completeness was postmarked on February 28, 2020.

On March 20, 2020, the City Planning Department issued a SEPA mitigated determination of non-significance (MDNS) for the above-described project. On April 21, 2020, the City received an appeal of the MDNS determination.

A consolidated open-record hearing before the City of Lynden Planning Commission on the SEPA Appeal, Planned Residential Development Permit, and Shoreline Substantial Development Permit will be held on October 21, October 22, October 29, and November 10, 2020. The hearings will begin at 6:30 PM on each date.

Due to the State’s restrictions on the Open Public Meetings Act and of gatherings of more than 5 people because of the possible transmission of the COVID-19 virus, the hearings will be held virtually via Microsoft Teams. The virtual format will allow participants to hear proceedings, see shared screens, and provide testimony.  The following link will provide a short tutorial on the use of Microsoft Teams.  Participants may also join the hearing via phone line. In addition to participating virtually, the City will provide the following options for participation:

• From 6:30 to 8:30 PM on October 29, the City will permit one-on-one live comment to the chairperson of the Planning Commission. A computer in the room will broadcast the comment live to everyone else signed into the Teams meeting. Those who sign up to speak will be invited into the building only when it is their assigned time to address the Commission. Persons interested in signing-up to speak in this way may contact the Planning Department at (360) 354-5532.

• For those unable join the virtual hearing from your home or have concerns related to their ability to hear the proceeding via their computer or phone, the City will be providing viewing rooms at City Hall.  No more than 5 people will be permitted in each room. These locations will not provide opportunities for spoken testimony.  If you would like to utilize these accommodations, please contact the Planning Department at (360) 354-5532.

• Recordings of each day of the hearing may be requested for download. A written transcript of all four days of the hearing will be made available after the close of the hearing.

• Written comments will be accepted until November 2nd.

Notice is hereby given that on September 28, 2020, the Sumas City Council approved a zoning conditional use permit and a consolidated shoreline substantial development permit allowing Italian Motors USA to expand an existing go-kart track facility on a site located at 529/481 W. Front Street, Sumas, WA. The approvals included conditions of approval established pursuant to Titles 14, 15 and 20 of the Sumas Municipal Code.

There is no administrative appeal of this decision.

Pursuant to Chapter 36.70C RCW, any petition challenging the decision regarding the conditional use permit must be filed with the superior court of Whatcom County within twenty-one days of the issuance of the decision.

Any appeal of the decision regarding the shoreline substantial development permit must be filed with the state shoreline hearings board within twenty-one days of the date of filing of the permit with the Washington Department of Ecology pursuant to RCW 90.58, the Shoreline Management Act.

This notice is published pursuant to Section 20.08.130(C) of the Sumas Municipal Code.
