LEGAL NOTICE OF PUBLIC HEARING REGARDING ORDINANCE 1603 FOR AN AMENDMENT TO CHAPTER 19.26  OF THE LYNDEN MUNICIPAL CODE

 

NOTICE IS HEREBY GIVEN that the Lynden City Council will be holding a public hearing and will be taking public input regarding an amendment to Chapter 19.26 of the Lynden Municipal Code specifically relating to section 19.26.030 regarding the minimum size for a development using the Medical Services Overlay, 19.26.090 clarifying language regarding development credits and potentially 19.26.060 relating to the approval process for the Medical Services Overlay.

A public hearing with the Lynden City Council has been scheduled for July 6, 2020.  Any persons wishing to comment on the proposal may do so by submitting their written comments to Heidi Gudde, Planning Director, 300 4th Street, Lynden, 98264 by June 29, 2020, or by attending the public hearing to be held on July 6, 2020 at 7:00 P.M., at the City of Lynden City Hall Annex, 205 4th Street.  Persons with questions regarding the proposal may contact Heidi Gudde at 354-5532.

There is no administrative appeal of this decision. Pursuant to Chapter 36.70C RCW, any petition challenging this decision must be filed with the superior court within twenty-one days of the issuance of the decision.

TAKE NOTICE: 

That George Sandhu of Whatcom County, Washington on March 26, 2020, has filed an application of seasonal change to Groundwater Certificate G1-*00106C(B) with a priority date of February 1, 1946. This certificate is currently being administratively split between its two owners; an (A) portion and a (B) portion will result. This seasonal change proposal applies to the (B) portion only. Certificated use is for 120.3 gallons per minute and 18.5 acre-feet per year for irrigation of 18.5 acres. The two current Points of withdrawal are located within NW¼ SE¼ of Section 15, Township 39N, Range 02E W.M. in Whatcom County. The place of use is also located within NW¼ SE¼ of Section 15, Township 39N, Range 02E W.M. 

The request here is to change the Points of Withdrawal and Place of Use. The proposed three Points of Withdrawal are located with the NW¼ SE¼ and the Place of Use is located within the SE¼, all within Section 15, Township 39N, Range 02E W.M. 

No increase will be made to the instantaneous withdrawal rate or annual quantity.

Protests or objections to approval of this application must include a detailed statement of the basis for objections. Protests must be accompanied with a fifty-dollar ($50.00) NON-REFUNDABLE recording fee (PLEASE REMIT CHECK OR MONEY ORDER ONLY) and filed with the Department of Ecology at the address shown below, within thirty (30) days from June 17, 2020.
