LEGAL NOTICE OF PUBLIC HEARING REGARDING

ORDINANCE 1625 FOR AN AMENDMENT TO CHAPTER 1.12 AND 14.16.050 OF THE LYNDEN MUNICIPAL CODE REGARDING DATUM PLANE AND DRIPPING OF PETROLEUM

 

NOTICE IS HEREBY GIVEN that the Lynden City Council will be holding a public hearing and will be taking public input regarding an amendment to Chapter 1.12 and 14.16.050 of the Lynden Municipal Code regarding datum plane and dripping of petroleum.  From time-to-time certain chapters of the Lynden Municipal Code need updating to provide clarification and to reflect changes that have been identified as outdated.

A public hearing with the Lynden City Council has been scheduled for July 19, 2021.  Any persons wishing to comment on the proposal may do so by submitting their written comments to Heidi Gudde, Planning Director, 300 4th Street, Lynden, 98264 by July 19, 2021, or by attending the public hearing to be held at 7:00 P.M., that same evening at the City Hall Annex building located at 205 4th Street.  Persons with questions regarding the details of the proposed updates may contact the Planning Department at (360) 354-5532.

EVERSON

NOTICE IS HEREBY GIVEN OF THE INTRODUCTION OF A CITY OF EVERSON ORDINANCE GRANTING TRANS MOUNTAIN PIPELINE (PUGET SOUND) LLC, A NONEXCLUSIVE FRANCHISE. This Ordinance, if adopted, will  grants a franchise to Trans Mountain Pipeline (Puget Sound) LLC, the nonexclusive right, privilege, authority and franchise to construct, operate, maintain, remove, replace, and repair existing pipeline facilities, together with equipment and appurtenances thereto, for the transportation of petroleum products and byproducts within and through the franchise area per the term of the franchise agreement. City of Sumas

Determination of Nonsignificance  (DNS)

 

Notice is hereby given that on July 6, 2021, the City of Sumas issued a Determination of Nonsignificance for the following proposal:

Description of proposal: Sumas Event Center and Grandstand Improvement Project.  The project includes major upgrades to the Sumas Event Center and Rodeo Grounds, including construction of new grandstands, restrooms and related parking and sidewalk improvements. The project also includes construction of a new stormwater management facility and outfall within the buffer of a Category II wetland adjacent to Bone Creek within the jurisdiction of the City’s Shoreline Master Program, reduction of a Category III wetland buffer by more than 25 percent, and wetland buffer enhancement plantings adjacent to Bone Creek wetlands to mitigate unavoidable impacts to wetland buffers.

Location of proposal: 1550 Cherry Street t within the NW ¼ of Section 2 and the NE ¼ of Section 3, Township 40 North, Range 04 East of W.M. in Sumas, Washington. The Assessor parcel numbers are 400403564458, 400403572408, 400402032440, and 400402031418.

Lead agency: City of Sumas

The lead agency for this proposal has determined that it does not have a probable significant adverse impact on the environment.  An environmental impact statement (EIS) is not required under RCW 43.21C.030(2)(c). This decision was made after review of a completed environmental checklist and other information on file with the lead agency.  This information is available to the public on request.

This DNS is issued under WAC 197-11-340(2).  The lead agency will not act on this proposal for fourteen days from the date of issuance of this determination.  Comments must be received by July 20, 2021.

There is no local agency appeal of this determination.

That Ebe Farms, LLC of Custer, Washington, on June 16, 2021, filed a seasonal application of change to Surface Water Certificate 6343 (aka S1-*13039CWRIS).

Certificated use under Surface Water Certificate 6343 is for 0.50 cubic feet per second for the irrigation of 50 acres during the irrigation season, with a priority date of July 23, 1954. The original point of diversion is located on the Nooksack River within Government Lots 8, 10, and 11 of Section 30, T. 40 N., R. 3 E.W.M., in Whatcom County. The original place of use is within Government Lots 8, 10, and 11 of Section 30, T. 40 N., R. 3 E.W.M.

The request is to transfer the point of diversion to within the NE1/4 SW1/4 of Section 35, T. 40 N., R. 2 E.W.M. The new place of use would be within Government Lots 3 and 4 of Section 35, T. 40 N., R. 2 E.W.M.
