DETERMINATION OF NON-SIGNIFICANCE

NOTICE IS HEREBY GIVEN that on August 10, 2020, the City of Lynden received a SEPA Checklist from Tyler Bosman, Honcoop Gravel, Inc., regarding the project described below:

Description of Proposal:  The repair and replacement of an existing failing driveway bridge over Pepin Creek.  A partial section of the existing residential driveway bridge is collapsed into the channel.  The failing foundation will be removed from the channel now, while the creek is dry, and replaced to support the new bridge.  

After reviewing the environmental checklist and other information on file with the agency, the City of Lynden has determined that this proposal will not have a probable significant adverse impact on the environment should standard conditions be met.  Copies of the DNS are available from the City of Lynden, 300 4th St., WA.  The public is invited to comment on this DNS by submitting written comments to Heidi Gudde, Planning Director, no later than Sept 1, 2021, at 300 4th Street, Lynden, WA  98264.

Notice of Public Hearing

NOTICE IS HEREBY GIVEN THAT the Sumas City Council will hold a public hearing at its regular council meeting on Monday, August 23, 2021 at 7:00 p.m. to hear comment on a proposed franchise agreement between Comcast Cable Communications Management, LLC, and the City of Sumas. The hearing will be held at the Sumas Council Chambers located in the Sumas City Hall at 433 Cherry Street, Sumas, WA.

At such hearing, the City Council will consider any comment offered and, at the conclusion of such hearing may correct, revise, change or modify the agreement. Following the hearing the City Council may consider and confirm approval of an ordinance granting Comcast Cable Communications Management, LLC a franchise and approving a franchise agreement. The following is a summary of the proposed ordinance:

Notice of Application, Public Hearing and

Probable SEPA Determination of Nonsignificance

The City of Sumas hereby gives notice of a pending application for a conditional use permit.  The applicant is Pacific Edge Builders LLC, which proposes to construct a single 6-unit multifamily residential structure on two contiguous parcels totaling approximately 14,212 square feet in lot area.

The subject parcels are located at 511 and 523 Second Street within the Residential, High-Density District and are situated in the NW ¼ of the SW ¼ of Section 35, Township 41 North, Range 04 East of W.M. within Sumas WA.  The properties are identified under Whatcom County Assessor’s parcel numbers 410435 102196 and 410435 109196.

The public comment period for this application is from August 18 through September 2, 2021.  Written comments may be submitted during that period to Sumas City Hall at the address shown below.

The Sumas City Council will hold a public hearing regarding this application at Sumas City Hall on September 13, 2021 beginning at 7:00 p.m. The complete application is available for review at Sumas City Hall during normal business hours.

The City expects to issue a Determination of Nonsignificance (DNS) for the proposal.  The application is being handled pursuant to the optional DNS process authorized in section 197-11-355 WAC, so comments about the environmental impacts of the proposal should be submitted within the above described comment period.  This may be the only opportunity to comment on the environmental impacts of the proposal. The proposal may include mitigation measures under applicable codes, and the project review process may incorporate or require mitigation measures regardless of whether an EIS is prepared.  A copy of the subsequent threshold determination for the proposal may be obtained upon request.

This matter involves a claim by Plaintiff that property conveyed to her by her mother by way of a Revocable Transfer on Death Deed (“Deed”), recorded under Whatcom County Auditor’s File No. 2017-1200408, contained an incorrect legal description for the property as a result of a scrivener’s error. Plaintiff seeks a reformation of the Deed to reference the correct legal description for the property and to thereby quiet title to the property in her name exclusively. Plaintiff maintains that the correct legal description is that contained in the July 20, 1984, Quit Claim Deed from Lonnie Collins to Roy and Elsie Burgy, recorded under Whatcom County Auditor’s File No. 1485498.

In the alternative, and to the extent the Deed did not convey the property to Plaintiff, her mother had all right, title, and interest in the property at the time of death, and Plaintiff was entitled under her mother’s will to all residue of her estate. Plaintiff thereby alternatively seeks an order and judgment quieting title to the property in her name exclusively.
