NOTICE OF APPLICATION TO CHANGE AN EXISTING WATER RIGHT

 

TAKE NOTICE:

That Leonard J Ebe Real Estate, LLC (Ebe Farms) of Custer, Washington, on August 18, 2017, filed an application of change to Groundwater Certificate 2184-A, with a priority date of May 1, 1953. Certificated use is for 320 gallons per minute and 64 acre-feet per year for the irrigation of 32 acres. THe point of withdrawal (POW) is located within the E½ of SE¼ of Section 6, Township 39 N, Range 2 E.W.M., in Whatcom County. The place of use (POU) is located within the SE¼ of Section 6, Township 39 N, Range 2 E.W.M.

The request is to change the POU and POW to agricultural properties owned by Ebe Farms. The proposed POU and POWs are located in Sections 5 and 6, Township 39 N, Range 2 E.W.M. No increase will be made to the instantaneous withdrawal rate or annual quantity.

Protests or objections to approval of this application must include a detailed statement of the basis for objections. Protests must be accompanied with a fifty-dollar ($50.00) NON-REFUNDABLE recording fee (PLEASE REMIT CHECK OR MONEY ORDER ONLY) and filed with the Department of Ecology at the address shown below, within thirty (30) days from May 1, 2019.

The total amount due and owing on the Judgment through March 26, 2019 is $85,711.62 consisting of the following: the judgment amount of $54,686.31 principal and interest; $24,383.14 awarded for fees; $3,061.50 awarded for attorneys’ fees and costs; plus additional prejudgment interest accruing from January 29, 2018 through the date of entry of the Amended Judgment on January 15, 2019 of $2,986.72 ($8.485 per diem x 352 days); plus post-judgment interest accruing after January 15, 2019 of $593.95 (48.485 per diem x 70 days); pursuance to the Judgment, post-judgment amounts advanced for attorneys’ fees and costs for publication and Sheriff’s fees of an unknown amount.

It is ordered, adjudged and decreed that the Sheriff is hereby authorized to make the return within 60 days after issuance by the court. For purposes of the sale, the Order may be automatically extended for 30 days, pursuant to RCW 6.21.050.

In the name of the State of Washington, you are hereby commenced and required to proceed to notice for sale and to sell the Subject Property, which is more particularly described in the Notice of Sale, and apply the proceeds of said sale as in said Judgment and Decree directed, and to make and file your report of such sale with the Clerk of this Court, and do all things according to the terms and requirements of said Judgment and the provisions of Washington Law.

Plaintiff agrees that no deficiency judgment shall be entered against Borrowers and that the court will establish an eight month redemption period from the date of the Sheriff’s foreclosure sale, and the Sheriff should be ordered to issue a Sheriff’s Deed to the successful bidder at the termination of the redemption period pursuant to RCW 6.23.020.
