LEGAL NOTICE OF APPLICATION FOR SHORELINE SUBSTANTIAL DEVELOPMENT PERMIT, AND PUBLIC HEARING

 

NOTICE IS HEREBY GIVEN that on February 19, 2020, the City of Lynden received a Shoreline Substantial Development Permit from Mark Sandal, Programs Manager for the City of Lynden, regarding the property described below:

COMMONLY DESCRIBED AS: 17th Street and Fishtrap Creek 

Project: SSD #20-01, 17th Street Extension 

Project Description: The City of Lynden is proposing to construct an extension of 17th St. as well as other various improvements along the 17th St. corridor. The design will include roadway, sanitary sewer, water main and drainage design. The proposal includes the construction of an extension of 17th St. from its existing northerly terminus, north approximately 400 feet to Main St. and replacement of the existing 17th St. water main from Liberty St. to Main St. with a new 12” water main. The water main will be located under replaced sidewalk and a replaced 6-foot wide section of asphalt pavement. Existing 17th St. will be also be ground and overlaid with 2 inches of asphalt from the 17th St. bridge over Pepin Creek north to the road extension. No structures or buildings will be affected by the proposed project.

A public hearing with the Lynden Planning Commission has been tentatively scheduled for May 14, 2020. Under Lynden Municipal Code 17.09.100, the final decision for this project must be made within 120 days from the date of the letter of completeness. Any persons wishing to comment on the application or the proposal may do by submitting their written comments to Heidi Gudde, Planning Director, 300 4th Street, Lynden 98264, by April 15, 2020, or by attending the public hearing to be held at 7:30 P.M. May 14, 2020, at the City of Lynden City Hall Annex, 205 4th Street, Lynden.

LEGAL NOTICE OF STATE ENVIRONMENTAL POLICY ACT DETERMINATION OF NON-SIGNIFICANCE

 

NOTICE IS HEREBY GIVEN that on March 11, 2020 the City of Lynden received a SEPA Checklist from Tim VandeVegte, regarding the project described below:

Description of Proposal: Lyngrove Townhomes – The construction of 3 townhome buildings (18 units total) and the associated residential infrastructure on a 1.64-acre parcel in Lynden, WA.

After reviewing the environmental checklist and other information on file with the agency, the City of Lynden has determined that this proposal will not have a probable significant adverse impact on the environment should standard conditions be met. Copies of the DNS are available from the City of Lynden, 300 4th St., WA. The public is invited to comment on this DNS by submitting written comments to Heidi Gudde, Planning Director, no later than April 15, 2020 at 300 4th Street, Lynden, WA 98264.

Notice of Application, Public Hearing and Probable SEPA Determination of Nonsignificance 

 

The City of Everson hereby gives notice that on February 27, 2020 an application for approval of the Falcon Landing long subdivision / preliminary plat was received from Bailey-Rhodes LLC. The applicant seeks to subdivide an approximately 4.49-acre property located in the Residential-7500 subzone to create 20 single-family residential lots. The subject property is located in the 400 block of Everson-Goshen Road in the SW ¼ of the SE ¼ and the SE ¼ of the SW ¼ of Section 36, Township 40N, Range 3E of W.M., Whatcom County, WA within the City of Everson. The property is identified under County Assessor’s parcel number 400336 250038. The public comment period for this application is from April 1 through April 16, 2020. Written comments may be submitted during that comment period to Everson City Hall at the address shown below. 

The City expects to issue a Determination of Nonsignificance (DNS) for the proposal. The application is being handled pursuant to the optional DNS process authorized in section 197-11-355 WAC, so comments about the environmental impacts of the proposal should be submitted within the above described comment period. This may be the only opportunity to comment on the environmental impacts of the proposal. The proposal may include mitigation measures under applicable codes, and the project review process may incorporate or require mitigation measures regardless of whether an EIS is prepared. A copy of the subsequent threshold determination for the proposal may be obtained upon request.

The Everson City Council will hold a public hearing regarding this proposal beginning at 7:00 p.m. on April 28, 2020 at Everson City Hall. Any party may submit written or oral testimony at the hearing.

The unnamed putative father of the children born to Laura T., on January 24, 2014, or the person who claims to be the father of the child born to Laura T., on January 24, 2014, is notified that a petition for adoption of the child was filed in the office of the Clerk of the Hamilton Superior Court, Room No. 1, One Hamilton County Square, Noblesville, Indiana. If the unnamed putative father seeks to contest the adoption of the child, the unnamed putative father must file a motion to contest the adoption in accordance with IC 31-19-10-1 in the above named court within thirty (30) days after the date of service of this notice. This notice may be served by publication. If the unnamed putative father does not file a motion to contest the adoption within thirty (30) days after service of this notice, the above named court shall hear and determine the petition for adoption. The unnamed putative father’s consent is irrevocably implied and the unnamed putative father loses the right to contest the adoption or the validity of the unnamed putative father’s implied consent to the adoption. The unnamed putative father loses the right to establish paternity of the child, by affidavit or otherwise, in Indiana or any other jurisdiction. Nothing Laura T. or anyone else says to the unnamed putative father of the child relieves the unnamed putative father of his obligations under this notice.

Under Indiana law, a putative father is a person who is named as or claims that he may be the father of a child born out of wedlock but who has not yet been legally proven to be the child’s father.

This notice complies with IC 31-19-4-4, but does not exhaustively set forth the unnamed putative father’s legal obligations under the Indiana adoption statutes. A person being served with this notice should consult the Indiana statutes.
