Dumped: Old city landfill lawsuit settled

LYNDEN — The city has settled a lawsuit with William Devine related to alleged contamination of his family’s property that was nearby a long-closed former city landfill on the west side of town.

The settlement, without determining any fault, is for $925,000 to Devine, of which the city’s insurance company from the time of the landfill, Liberty Mutual, pays $750,000, and the city takes possession of the three-acre property at 194 Birch Bay-Lynden Road.

The Lynden City Council approved the settlement after an executive session at its Feb. 19 meeting. Negotiations had been going on for a while, especially involving City Attorney Robert Carmichael.

Mayor Scott Korthuis called the settlement “the path of least resistance to a problem that doesn’t exist.”
